Terms of Service for ITBros LLC – Managed WordPress Hosting

These Terms of Service (“Agreement”) govern the use of the managed WordPress hosting services provided by ITBros LLC to the customer (“Customer” or “You”). By using our services, you acknowledge and agree to be bound by the terms and conditions outlined in this Agreement.

  1. Services
    1. Provision of Services: Company agrees to provide managed WordPress hosting services (“Services”) as described in the service agreement or order form signed by both parties.
    2. Service Level Agreement (SLA): Company will make reasonable efforts to provide uninterrupted Services. However, Company does not guarantee continuous availability and reserves the right to perform necessary maintenance, upgrades, or modifications.
  2. Customer Responsibilities
    1. Acceptable Use: Customer agrees to use the Services lawfully, complying with all applicable laws and third-party rights. Customer shall not use the Services for illegal, abusive, or unethical activities.
    2. Account Security: Customer is responsible for maintaining the confidentiality of account login information and ensuring the security of their account. Any unauthorized use or breach of security must be reported to ITBros immediately.
  3. Intellectual Property
    1. Ownership: ITBros retains all intellectual property rights in the Services, including software, trademarks, and proprietary materials.
    2. Customer Content: Customer retains ownership of all content uploaded, stored, or transmitted through the Services, granting ITBros a limited license solely for providing the Services.
  4. Payment and Billing
    1. Fees: Customer agrees to pay the fees specified in the service agreement. Fees may include recurring charges, setup fees, or additional charges for extra services.
    2. Payment Terms: All invoices/subscriptions must be paid within ten (10) days of the invoice due date. Overdue accounts will be charged at 1.5% per month (18% annually). Failure to pay may result in account suspension or termination.
  5. Limitation of Liability
    1. Disclaimer of Warranties: The Services are provided on an “as is” and “as available” basis. ITBros makes no warranties regarding their error-free operation or suitability for specific purposes.
    2. Indemnification: Customer agrees to indemnify and hold ITBros harmless from any claims, damages, or liabilities arising from the use of the Services.
  6. Termination
    1. Termination by Customer: Customers may terminate Services with written notice. No refunds will be issued for prepaid fees.
    2. Termination by ITBros: ITBros may suspend or terminate Services if the Customer violates this Agreement or engages in harmful activities.
  7. Miscellaneous
    1. Governing Law: This Agreement is governed by the laws of North Carolina. Any disputes shall be resolved in North Carolina courts.
    2. Entire Agreement: This Agreement constitutes the entire agreement between the parties and supersedes any prior understandings.

ITBros LLC Computer Remote Support Terms

By using ITBros Computer Remote Support services, you agree to these terms.

  1. Services Provided: ITBros provides remote and in-person technical support for personal computers, laptops, and peripherals.
  2. Scope of Service: ITBros will use reasonable efforts to troubleshoot issues but does not guarantee resolution.
  3. Confidentiality: ITBros will not share or disclose customer information unless required by law.
  4. Limitation of Liability: ITBros is not responsible for any direct, indirect, or consequential damages arising from the use of our services.
  5. Modifications to Terms: ITBros may modify these terms at any time, and continued use constitutes acceptance of modifications.

Text Notifications

  1. By opting into ITBros text notifications, you agree to receive service updates and alerts, Support case text. Message and data rates may apply.
  2. No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Changes and Notifications

These terms are subject to change at any time, and you will be notified of changes via email or text message.
